IMPORTANT NOTICE: These Terms of Service govern your access to and use of this online CPD programme. By enrolling, you confirm that you have read, understood, and agree to be bound by these terms. If you do not agree, please do not enrol or access the programme.

OVERVIEW

This CPD e-learning programme is created and offered by Liam Van Zyl (“the Course Creator”). Liam Van Zyl is a private individual acting in a personal capacity and is not a registered company, corporation, or other legal entity. The course is hosted on Thinkific, a third-party online learning platform operated by Thinkific Labs Inc. Throughout these Terms, the terms “the Course Creator”, “we”, “us” and “our” refer to Liam Van Zyl in that capacity. The programme delivers accredited Continuous Professional Development (CPD) e-learning content for professionals registered with the Health Professions Council of South Africa (HPCSA).

By accessing this platform and/or enrolling in a course, you agree to be bound by these Terms of Service, the Privacy Policy, and any additional policies referenced herein. These Terms apply to all users, including browsers, enrolled learners, and any other visitors to the site.

SECTION 1 – USER ACCOUNT AND RULES OF CONDUCT

You agree to notify the Course Creator immediately of any unauthorised use of your account or any breach of security. You may not use another user’s account without permission.

The Course Creator reserves the right to terminate your account if you violate any provision of these Terms or fail to comply with requests concerning your account.

The Course Creator reserves the right, at any time and at sole discretion, to cease providing any content, to change or discontinue any aspect or element of the course, or to cease making the course available.

Links on this platform to third-party websites are provided solely as a convenience. The Course Creator does not approve or endorse the content of linked third-party sites and accepts no responsibility or liability with regard to your use of any linked third-party sites.

Nothing in these Terms grants you any right or licence to use any trademarks, service marks, or logos associated with this course. You agree not to use or register any name, logo, or insignia associated with this course for any purpose without the prior written consent of the Course Creator.

SECTION 2 – CPD PROGRAMME RULES AND HPCSA REQUIREMENTS

The following specific rules apply to CPD programme participation, in alignment with HPCSA CPD guidelines:


SECTION 3 – COURSE CONTENT AND COPYRIGHT

All rights, including copyright and database rights, in this course and its content — including but not limited to text, course materials, assessments, designs, graphics, video and audio material, and the selection and arrangement thereof — are owned by the Course Creator and/or the respective open-access publishers of included academic articles.

The peer-reviewed articles included in this programme are open-access publications licensed under Creative Commons Attribution 4.0 International (CC BY 4.0). Their inclusion in this programme does not transfer copyright ownership to the Course Creator or to enrolled users.


SECTION 4 – USE OF THE COURSE AND CONTENT

You may only make non-commercial use of this course and its content. You may access the content for your own personal professional development only.

You may not reproduce, retransmit, publish, distribute, display, or otherwise make available any of the content to others, whether for remuneration or for free, without prior written consent from the Course Creator.

You may not modify, copy, reproduce, distribute, transmit, perform, publish, licence, create derivative works from, transfer, sell, or make available any content obtained from this course (whether in hard copy or electronic format).


SECTION 5 – ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

While every effort is made to ensure that the quality and accuracy of course content is of the highest standard, the course and its content are provided “as is”. The Course Creator makes no warranty about the accuracy, reliability, completeness, timeliness, or quality of the content, nor that any particular content will continue to be made available.

The material in this course is provided for CPD and general professional development purposes only and should not be relied upon as the sole basis for clinical, psychological, or professional decision-making. The Course Creator reserves the right to modify or update course content at any time.


SECTION 6 – MODIFICATIONS TO THE SERVICE AND PRICES

Enrolment fees for courses are subject to change without notice. The Course Creator reserves the right to modify, discontinue, or replace any programme or feature at any time and without notice.

The Course Creator will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the service.


SECTION 7 – PAYMENT

All payments for course enrolment are processed exclusively through Thinkific’s integrated payment processors. The Course Creator does not directly handle, process, or store any payment or financial information. By completing a purchase, you also agree to the payment terms of Thinkific’s platform.

All payments must be made in full prior to accessing course content. The Course Creator reserves the right to refuse or cancel any enrolment that appears to be fraudulent or in violation of these Terms.

SECTION 8 – THIRD-PARTY PLATFORM (THINKIFIC)

This course is hosted on Thinkific, a third-party online learning platform operated by Thinkific Labs Inc. (Canada). The Course Creator uses Thinkific solely as a hosting and delivery platform and does not operate, own, or control the Thinkific platform itself. By using this platform, you also agree to Thinkific’s own Terms of Service and Privacy Policy.

The Course Creator is not responsible for any technical issues, interruptions, data handling practices, or other matters arising from Thinkific’s platform operations. Any use of third-party tools or services integrated with Thinkific is at your own risk.


SECTION 9 – THIRD-PARTY LINKS

Course content may include links to external third-party websites, including open-access journal publishers and academic databases. The Course Creator is not responsible for examining or evaluating the content, accuracy, or privacy practices of those sites and accepts no liability for any harm or damages arising from your use of them.

Once you leave this platform or are redirected to a third-party website, you are no longer governed by these Terms of Service or the Privacy Policy.


SECTION 10 – USER FEEDBACK AND CONTENT

If you provide feedback, suggestions, ratings, or ideas regarding the programme, the Course Creator may use such feedback without any obligation to you. You waive any claim to ownership or compensation for such feedback.

You are solely responsible for any content you post or submit through the platform. The Course Creator reserves the right, but has no obligation, to monitor, edit, or remove content that is determined in sole discretion to be unlawful, offensive, or otherwise objectionable.

SECTION 12 – ERRORS, INACCURACIES AND OMISSIONS

Occasionally there may be information in this course containing typographical errors, inaccuracies, or omissions relating to course descriptions, pricing, or availability. The Course Creator reserves the right to correct any such errors at any time without prior notice.

SECTION 14 – DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

14.1  Private individual capacity

This course is created and offered by the Course Creator, Liam Van Zyl, a private individual acting in a personal capacity. The Course Creator does not operate the Thinkific platform on which this course is hosted; Thinkific is an independent third-party platform. The Course Creator is not a registered company, corporation, or legal entity. Accordingly, all limitations of liability set out in this section apply to the Course Creator personally and in full.


14.2  Disclaimer of warranties

The Course Creator does not guarantee that your access to this course will be uninterrupted, timely, secure, or error-free. The course and all content are provided ‘as is’ and ‘as available’, without any representation, warranties, or conditions of any kind, either express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement.


14.3  Exclusion of liability – direct and indirect damages

To the maximum extent permitted by applicable law (including Finnish law and EU consumer protection law), the Course Creator shall not be liable to you or any third party for any damages of any kind arising out of or relating to your use of, or inability to use, this course or its content. This exclusion applies to all categories of loss, including without limitation:

14.4  Aggregate liability cap

Notwithstanding any other provision of these Terms, if the Course Creator is found liable to you for any reason whatsoever, the total aggregate liability of the Course Creator to you shall not exceed the total amount actually paid by you for the specific course from which the claim arises. This cap applies to all claims in aggregate, regardless of the number of claims or the legal basis on which they are brought.


14.5  Professional responsibility

The content in this course is provided for CPD and general professional development purposes only. Nothing in this programme constitutes professional psychological, clinical, legal, or other regulated advice. You remain solely responsible for the way in which you apply course content in your professional practice. The Course Creator accepts no liability for any outcome arising from your reliance on course content in any professional context.


14.6  HPCSA accreditation

The Course Creator makes no representation that completion of this programme guarantees acceptance of CPD points by the HPCSA or any specific professional board. It remains your sole responsibility to confirm accreditation status and CPD requirements with your relevant registered professional board.


SECTION 15 – COPYRIGHT COMPLAINTS

The Course Creator respects the intellectual property rights of others. If you believe your copyright has been violated in connection with this course, please notify the Course Creator by email at [email protected]. The matter will be investigated and appropriate action taken.


SECTION 16 – INDEMNIFICATION

You agree to indemnify and hold harmless the Course Creator and any affiliated service providers from any claim or demand, including reasonable legal fees, arising out of your breach of these Terms, your violation of any applicable law, or your infringement of the rights of any third party.


SECTION 17 – SEVERABILITY

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be struck to the minimum extent necessary, and shall not affect the validity or enforceability of the remaining provisions. Your rights under these Terms are personal, non-exclusive, and non-transferable.

Headings in these Terms are for reference purposes only and do not define, limit, or otherwise affect the scope of any provision.


SECTION 18 – TERMINATION

These Terms are effective unless and until terminated by either party. You may terminate at any time by ceasing to use this platform. The Course Creator may terminate your access at any time, without notice, if you breach any provision of these Terms. Obligations and liabilities incurred prior to termination will survive.


SECTION 19 – ENTIRE AGREEMENT

These Terms of Service, together with the Privacy Policy and any policies posted on this platform, constitute the entire agreement between you and the Course Creator regarding the use of this course. They supersede any prior agreements, communications, or proposals between the parties. The Course Creator’s failure to act with respect to a breach does not waive the right to act with respect to subsequent or similar breaches.


SECTION 20 – GOVERNING LAW AND JURISDICTION

These Terms of Service are governed by and construed in accordance with the laws of Finland and, where applicable, the laws of the European Union, including but not limited to the General Data Protection Regulation (GDPR) (EU) 2016/679 and applicable EU consumer protection directives.

Given that this programme is primarily directed at HPCSA-registered professionals in South Africa, the applicability of relevant South African consumer protection legislation, including the Consumer Protection Act 68 of 2008, is acknowledged to the extent that it applies to South African-based users.

Any disputes arising out of or in connection with these Terms shall first be attempted to be resolved amicably. If unresolved, disputes shall be subject to the jurisdiction of the competent courts of Finland.


SECTION 21 – CHANGES TO TERMS OF SERVICE

The Course Creator reserves the right to update or replace these Terms at any time by posting changes to this platform. Changes are binding upon posting and your continued use of the platform constitutes acceptance of the modified Terms. It is your responsibility to review these Terms periodically.
